Climbing Wall Waiver, Release Of Claims And Indemnification Agreement
I wish to use the St. Olaf Tostrud Center Climbing and Bouldering Wall. I am not required to use this facility and understand my participation is voluntary. I am aware that climbing and bouldering can be dangerous and involve many risks including, but not limited to, death, serious neck and spinal injuries, serious injury to bones, and other serious injuries. In consideration of my being permitted to use the St. Olaf Tostrud Center Climbing and Bouldering Wall (the “Climbing Wall”), I, on behalf of myself, my family, estate, heirs, representatives and assigns, hereby release and promise not to sue St. Olaf College, its Board of Regents, its employees, independent contractors, instructors, agents, insurers, architects, and builders, and all other persons and entities (hereinafter “Released Parties”) from any and all present and future claims, demands, actions or causes of action resulting from any personal injury or death, or any loss damage, or theft of property, resulting from my using the climbing and bouldering wall and climbing equipment (hereinafter “Claims”), including any Claims relating to climbing equipment of my own or of others that I choose to use in the Tostrud Center in lieu of St. Olaf’s equipment. In addition to the foregoing, I further agree to defend and indemnify the Release Parties from any Claims asserted against them resulting from my use of the Climbing Wall. I realize that I may choose to use a helmet while I climb or boulder. I accept all responsibility for injuries I may suffer as a result of my choosing at any time not to use a helmet. If I choose to use my own harness, I agree that I will inspect it regularly for safety and accept all responsibility for injuries I may suffer as a result of my use of my own harness. In addition to this Waiver, Release of Claims and Indemnification Agreement, I have also signed the College’s Agreement for Assumption of Risk, Indemnification, Release, and Consent for Emergency Treatment which applies to all St. Olaf athletic facilities, including the Climbing Wall, and the terms of which I agree are incorporated herein by reference. I understand that this Waiver, Release of Claims and Indemnification Agreement is intended to be as broad and inclusive as permitted by the laws of the state of Minnesota and I agree that if any portion is held invalid, the remainder of this agreement shall continue in full legal force and effect. I further agree that the venue for any legal proceedings related to my use of the Climbing Wall shall be in the state of Minnesota.
Climbing Wall Policies
All participants must check-in with TCW staff and sign-in prior to climbing.
Everyone who enters the climbing area must have a completed TCW Policy form filled out along with a TCW Waiver and Release of Liability form.
Participants may use harnesses, shoes, carabiners, belay devices, and other equipment provided by the Tostrud Center.
Climbers may use personal climbing equipment that meets safety standards (harness, belay device, etc.) at the TCW.
Belay certification must be given by a St. Olaf TCW Supervisor and renewed each semester.
Climbers must tie into their harness with a figure 8 follow through knot.
Ground anchors are available if needed.
Proper climbing commands must be utilized.
Climbers must follow all posted rules and staff instructions.
Rings and loose jewelry must be removed before climbing.
Bags, water bottles, and other personal items are not allowed in the climbing area.
Only climbing shoes or athletic shoes are permitted. Street shoes and bare feet are not allowed.
Climbing on top of the bouldering wall (topping out) is not permitted. Make sure you are not walking under someone who is bouldering.
Headphones are not allowed while climbing or belaying.
Climbers are not permitted to teach other climbers to belay or lead climb in the facility.
Climbers must be a member of the St Olaf Community to climb during open gym hours.
St. Olaf College is not responsible for lost or stolen items. Please keep personal items outside of the climbing area: cubbies are provided.
No food, beverages, personal belongings or glass are allowed in the climbing area.
No grabbing, pulling or stepping on the quick draws or bolt hangers.
Clean any open wound and bandage it appropriately before continuing to climb.
Report any accidents or damaged equipment to the climbing wall staff on duty.
Attire must cover chest and buttocks fully.
Anyone found to be climbing or belaying under the influence of alcohol or drugs will have their privileges suspended.
No belaying sitting down.
Belay certifications can be revoked if improper belay techniques are being practiced
TCW Supervisors have the authority to enforce all policies. Any violation of policies may result in the suspension of climbing and bouldering privileges and removal from the Wall. In addition, staff will ask any uncooperative or unsafe people to leave the TCW.
I have read and understand the above waiver and policies for the use of the climbing wall.
